Terms of Service

Welcome to MyNannyTutor. These Terms of Service ("Terms") govern your access to and use of the MyNannyTutor platform, including our website, applications, and AI tutoring services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the Service.

1. About the Service

MyNannyTutor provides an AI-powered homework tutoring service ("Nancy") designed for primary school children (ages 5–12). Nancy helps children with homework through interactive voice sessions, written explanations, and visual demonstrations on a shared digital board. Nancy is an artificial intelligence — not a human tutor.

The Service also provides parent dashboards with session reports, academic progress tracking, and teacher tools for classroom integration.

2. Eligibility

  • You must be at least 18 years old to create an account.
  • Parent accounts are for parents or legal guardians of children who will use the Service.
  • Teacher accounts are for verified educators who use the Service in an educational capacity.
  • Children may only use the Service through a child account created and managed by their parent or legal guardian.
  • By creating a child account, you represent and warrant that you are the parent or legal guardian of the child.

3. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate and complete registration information.
  • You must promptly update your information if it changes.
  • You must notify us immediately if you suspect unauthorised use of your account.

4. Acceptable Use

The Service is provided exclusively for legitimate educational tutoring of children. You agree not to:

4.1 General Prohibitions

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable.
  • Interfere with or disrupt the Service, its servers, networks, or infrastructure.
  • Attempt to probe, scan, or test the vulnerability of the Service or any related system.

4.2 AI and Content Exploitation

  • Use the homework preparation pipeline, OCR processing, or AI analysis features to extract answers, solutions, or processed content without engaging in paid tutoring sessions — including uploading homework in bulk to obtain AI-generated answers at no cost.
  • Upload non-homework content (business documents, contracts, essays, personal correspondence, forms, or any other material) to exploit our OCR or AI processing capabilities as a free document digitisation or analysis service.
  • Frame non-academic or non-homework questions as "homework" to use Nancy as a general-purpose AI assistant, research tool, or content generator.
  • Deliberately craft inputs, embed hidden instructions in uploaded images, or otherwise attempt to manipulate, jailbreak, or circumvent Nancy's safety filters, content guardrails, or instructional boundaries.
  • Systematically probe, test, or map Nancy's AI behaviour, hint progressions, pedagogical methods, or content filtering rules for any purpose including competitive analysis, AI training, or product development.
  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code, algorithms, models, or methodologies underlying the Service.

4.3 Commercial Exploitation and Resale

  • Use the Service as a backend for your own tutoring, homework help, or educational business — whether paid or unpaid — without our explicit written authorisation.
  • Record, screenshot, screen-capture, or otherwise reproduce Nancy's tutoring sessions, board demonstrations, step-by-step explanations, or any AI-generated educational content for redistribution, resale, publication, or broadcast on any platform (including but not limited to social media, video platforms, messaging apps, or e-commerce sites).
  • Repackage, rebrand, or present the Service's outputs, methodology, or content as your own work or the work of any third party.
  • Use a teacher account to generate lesson plans, teaching materials, or educational content for use in a separate paid tutoring or teaching business.

4.4 Account Integrity

  • Share, sell, lend, trade, or transfer your account credentials, access, or purchased minutes to or with any other person or entity.
  • Allow multiple individuals, families, or households to access the Service through a single account.
  • Create multiple accounts for the same individual or household to circumvent usage limits, exploit introductory offers, evade a ban or suspension, or for any other purpose.
  • Register for a teacher account if you are not a verified educator using the Service in a legitimate educational capacity.
  • Add individuals who are not your genuine students to a teacher class roster to grant them unauthorised access to the Service.
  • Use a teacher account to harvest, collect, or export parent or student contact information, academic data, or personal data for any purpose outside the Service.
  • Use automated tools, bots, scripts, or scrapers to access the Service, create accounts, or perform any actions without our express written permission.

4.5 Payment and Financial Abuse

  • Use stolen, fraudulent, or unauthorised payment methods to purchase minutes or any other Service features.
  • Initiate payment chargebacks, disputes, or reversals in bad faith after having received and consumed the Service.
  • Exploit or attempt to exploit any pricing error, promotional offer, or system glitch to obtain minutes or services at unintended prices or quantities.

4.6 Gamification Exploitation

  • Farm, manipulate, or exploit the gamification system (badges, points, streaks, rewards, classroom races, or challenges) through repetitive trivial interactions, automated actions, or any method that does not reflect genuine educational engagement.
  • Exploit the reward redemption system or classroom reward features to obtain benefits, goods, or privileges not earned through legitimate tutoring activity.

4.7 Catch-All

The above list is illustrative and not exhaustive. We reserve the right to determine, at our sole discretion, whether any conduct constitutes a violation of these Terms. Any use of the Service that we reasonably believe is abusive, fraudulent, harmful to other users, damaging to our business interests, or inconsistent with the intended purpose of the Service (legitimate educational tutoring of children) may result in immediate suspension or permanent termination of your account, with forfeiture of all remaining minutes and without refund, credit, or compensation of any kind.

5. AI Tutoring Disclosure

Nancy is an artificial intelligence system. While we design Nancy to be accurate, patient, and educationally sound, you acknowledge that:

  • Nancy may occasionally make errors or provide imperfect explanations.
  • Nancy is a supplementary learning aid, not a replacement for qualified teachers or formal education.
  • Nancy's tutoring approach is designed to guide children toward answers, not to provide answers directly.
  • AI-generated content and interactions are produced by machine learning models and should be treated accordingly.
  • We continuously improve Nancy, and her capabilities and behaviour may change over time.

6. Homework Photos and User Content

When you or your child upload homework photos or other content to the Service ("User Content"):

  • You retain ownership of your original User Content.
  • You grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable licence to use, reproduce, process, store, analyse, modify, create derivative works from, and otherwise exploit User Content for the purposes of: (a) providing, maintaining, and improving the tutoring service; (b) training, developing, validating, and improving our artificial intelligence systems, machine learning models, and educational technology; (c) deriving anonymised, de-identified, and aggregated insights, analytics, educational benchmarks, and data products; and (d) any other purpose described in our Privacy Policy. This licence survives termination of your account with respect to anonymised and de-identified derivatives.
  • Homework photos are processed using optical character recognition (OCR) and AI analysis to extract questions and provide tutoring assistance.
  • Homework photos only: The upload feature is intended exclusively for school homework, worksheets, and academic assignments. You may not upload non-homework content (business documents, personal correspondence, contracts, creative writing, research papers, or any other material) to exploit our OCR or AI processing capabilities.
  • We do not use your User Content for advertising, marketing, or any purpose unrelated to the tutoring service.
  • You are responsible for ensuring you have the right to upload any content you submit.
  • We reserve the right to automatically or manually review uploaded content and reject, delete, or flag material that is not legitimate homework.

7. Data, Analytics, and Technology Development

By using the Service, you acknowledge and agree that:

  • Service interaction data: All data generated through your and your child's use of the Service — including but not limited to tutoring session interactions, question-and-answer exchanges, pedagogical outcomes, session transcripts, homework content, academic performance metrics, engagement patterns, voice interactions, board interactions, gamification activity, and all associated metadata (collectively, "Interaction Data") — may be used by MyNannyTutor for the purposes described in our Privacy Policy, including service improvement, technology development, artificial intelligence and machine learning model training, and the creation of anonymised analytical products.
  • Artificial intelligence training: You expressly acknowledge that Interaction Data may be used to train, fine-tune, validate, calibrate, and improve proprietary artificial intelligence models, machine learning systems, natural language processing systems, speech and voice processing systems, pedagogical decision-making algorithms, and content generation systems. Models and systems trained or improved using your Interaction Data become the exclusive intellectual property of MyNannyTutor. You have no ownership interest in, and shall assert no claim over, any model, algorithm, system, or derivative work produced through such training.
  • Anonymised derivatives: MyNannyTutor may derive anonymised, de-identified, and aggregated data, statistical models, performance benchmarks, educational insights, curriculum analytics, difficulty assessments, and other derivative works from Interaction Data (collectively, "Derived Data"). Derived Data is the sole and exclusive property of MyNannyTutor and may be used, licensed, sold, published, or otherwise commercialised without restriction or compensation to you. Your deletion of your account or data does not affect Derived Data or any models or systems trained using anonymised versions of your Interaction Data.
  • No compensation: You are not entitled to any royalty, payment, revenue share, equity, or other form of compensation arising from MyNannyTutor's use of Interaction Data or Derived Data, regardless of the commercial value generated therefrom.

8. Minutes Packages and Payments

  • The Service operates on a prepaid minutes-based model. You purchase a package of tutoring minutes in advance.
  • Each minutes package has a specified validity period. Unused minutes expire at the end of the validity period and cannot be carried over, extended, or transferred.
  • No refunds: Purchased minutes are non-refundable. There are no partial refunds for unused minutes, regardless of the reason for non-use.
  • Minutes are deducted based on the duration of active tutoring sessions with Nancy.
  • We reserve the right to change package pricing. Price changes will not affect already-purchased packages.
  • All payments are processed securely through Stripe. We do not store your payment card details.
  • You are responsible for monitoring your remaining minutes balance. We may send courtesy notifications when your balance is low, but we are not obligated to do so.

9. Intellectual Property

  • The Service — including its design, user interface, AI models, tutoring methodology, algorithms, board demonstration system, hint progression logic, gamification mechanics, and all AI-generated educational content — is owned by MyNannyTutor and protected by applicable intellectual property laws.
  • You may not copy, reproduce, record, screenshot, modify, distribute, publicly display, or create derivative works based on any part of the Service or its outputs without our explicit written permission.
  • The MyNannyTutor name, Nancy character, Nancy's voice and persona, and all associated branding are our trademarks and proprietary assets.
  • You are granted a limited, personal, non-transferable, non-exclusive, revocable licence to use the Service for its intended purpose (legitimate educational tutoring of your children). This licence does not include the right to reproduce, redistribute, or commercialise any Service content or output.
  • Session reports and academic progress data are provided to you for your personal, non-commercial use in supporting your child's education. They may not be sold, distributed, or used for commercial purposes.

10. Privacy

Your use of the Service is also governed by our Privacy Policy and Children's Privacy Policy, which describe how we collect, use, and protect your personal data and your child's data.

11. Abuse Detection, Suspension, and Bans

We employ automated and manual monitoring to detect abuse patterns and protect the integrity of the Service for all users. We reserve the right to suspend or permanently ban accounts at our sole discretion for any violation of Section 4 (Acceptable Use) or any other provision of these Terms.

11.1 Enforcement Actions

Depending on the severity, frequency, and nature of the violation, we may take one or more of the following actions without prior notice:

  • Warning: A notice to cease the offending behaviour.
  • Feature restriction: Temporary or permanent revocation of specific features (e.g., homework upload, teacher class management).
  • Account suspension: Temporary suspension of all account access for a defined period.
  • Permanent ban: Permanent and irreversible termination of your account and all associated child accounts.

11.2 Consequences of Suspension or Ban

  • All remaining purchased minutes are permanently forfeited. No refund, credit, transfer, compensation, or remedy of any kind will be provided for unused minutes on a suspended or banned account.
  • All associated child accounts are also suspended or banned.
  • If your account was linked to a teacher class, your students will be removed from the class and the teacher will be notified.
  • You may not create a new account or access the Service through any other account following a permanent ban. Any new accounts created in violation of a ban will be immediately terminated.
  • We reserve the right to report fraudulent or illegal activity to relevant law enforcement authorities.

11.3 Appeals

If you believe your account was suspended or banned in error, you may submit an appeal to support@mynannytutor.com within 14 days of the enforcement action. We will review your appeal and respond within 30 days. Our decision on appeal is final. Submitting an appeal does not entitle you to reinstatement or refund, and minutes continue to forfeit during the appeal period.

12. Termination

  • You may delete your account at any time through the account settings or by contacting us. Voluntary account deletion does not entitle you to a refund of unused minutes.
  • We may suspend or terminate your account if you violate these Terms or engage in behaviour that harms the Service or other users.
  • Upon termination, your right to use the Service ceases immediately, and any remaining minutes balance is forfeited.
  • We will handle your data in accordance with our Privacy Policy, including any applicable data retention or deletion requirements.

13. Disclaimers

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
  • We do not guarantee that the Service will be uninterrupted, error-free, or secure.
  • We do not guarantee specific educational outcomes from using the Service.
  • Nancy's tutoring is supplementary and does not replace professional educational assessment or instruction.

14. Limitation of Liability

To the maximum extent permitted by applicable law, MyNannyTutor shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, loss of purchased minutes, loss of educational progress data, or educational outcomes, arising out of or relating to your use of the Service.

Without limiting the foregoing, MyNannyTutor shall bear no liability whatsoever for any losses, damages, or expenses you incur as a result of account suspension, termination, or ban (including forfeiture of purchased minutes) carried out in accordance with these Terms.

Our total aggregate liability for any claim arising from or relating to the Service shall not exceed the total amount you paid us in the twelve (12) months preceding the claim, or HKD 500, whichever is lower.

15. Indemnification

You agree to indemnify, defend, and hold harmless MyNannyTutor, its officers, directors, employees, contractors, and agents from any and all claims, damages, losses, liabilities, and expenses (including reasonable legal fees and costs) arising out of or relating to: (a) your use or misuse of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your violation of any rights of a third party; or (e) any content you upload to the Service.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a prominent notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service before the effective date.

17. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region ("Hong Kong SAR"). Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong SAR.

Before initiating any legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at support@mynannytutor.com. We will make reasonable efforts to resolve the dispute within 30 days.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect. The invalidity of any single provision does not affect the validity of the remaining Terms.

19. Entire Agreement

These Terms, together with the Privacy Policy and Children's Privacy Policy, constitute the entire agreement between you and MyNannyTutor regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
